& Spruill LLP represents creditors and debtors
in Chapter 11 business bankruptcy cases nationwide. Firm attorneys
also undertake creditor representation in consumer cases within North
Carolina and, on the national level, advise national consumer credit
companies with regard to policy, defend class action suits and provide
representation and advice in exception cases nationwide.
In the area of business
bankruptcy, our attorneys represent bank lenders, trade creditors,
lessors, committees of unsecured creditors and other court appointed
committees, equity holders, buyers purchasing assets from bankrupt
companies and others involved in Chapter 11 cases nationwide.
For business debtors, we will
file Chapter 7 liquidation or Chapter 11 reorganization proceedings
and handle all aspects of the Chapter 11 case. Our firm attorneys in
other practice areas such as employee benefits, corporate,
environmental, etc. enable our firm to handle all aspects of a case
without the necessity for additional "special counsel."
Our creditors’ rights practice
actively advises lenders and trade creditors in matters designed to
protect them from exposure in the event a customer files bankruptcy
and to enhance the collectibility of accounts receivable. The firm
also handles collections and foreclosures for creditor clients and
workouts for lenders.
Our consumer creditors' practice
represents secured and unsecured lenders who lend to individuals or
sole proprietorships. Our lender clients are secured by debtor's
homes, mobile homes, cars or specific consumer goods or
appliances. We also represent credit card companies and others
who make unsecured consumer loans.
MAJOR PRACTICE AREAS:
Our attorneys are active in the
American Bankruptcy Institute, are familiar with courts and judges
nationwide and are able to effectively represent business creditor
clients and lender clients in bankruptcy matters throughout the
nation.
In North Carolina, in addition to
Bankruptcy, we represent clients in state and federal courts in all
counties and the three federal judicial districts.
